Participating in Workplace Health and Safety Decisions

One of the three fundamental worker rights protected by law is the right to participate in workplace health and safety decisions.

Under the Occupational Health and Safety Act and the Occupational Health and Safety Regulations, employers must either establish:

  • an Occupational Health Committee in each workplace that has 10 or more workers, whether the workers are full-time, part-time or both. Committees have between 2 and 12 members, depending on the size of the workplace. Employer members (management) must not out number worker members (see the Act, section 15).
  • an Occupational Health and Safety Representative in any high-hazard workplaces where occupational health committees are not required,  i.e. employers who have from 5 to 9 workers (see  Regulation, Table 7 of the Appendix).
